Constitutional issues related to the civil commitment of sexually violent predators in Washington are addressed. This paper is divided into five parts: the U.S. Supreme Court's civil commitment jurisprudence; the framework for assessing whether treatment is constitutionally adequate; the SCC's (Washington State's Special Containment Center) non-compliance with its constitutional obligations; the relationship between the requirement of constitutionally adequate treatment and the constitutionality of civil commitment; and conclusion.
